General Terms and Conditions (T&C)
§ 1 Scope
These Terms and Conditions apply to all orders placed via the online shop allesfahnen.ch. Contractual partner is alles fahnen! produktionsgmbh, Alliogasse 29-33, 1150 Vienna, Austria (referred to as "we" or "us" below).
Contractual languages: German, French, Italian, English. Only the German version is legally binding in case of divergent interpretation.
§ 2 Conclusion of contract
The presentation of products in our shop does not constitute a binding offer. By submitting an order, you make a binding offer to conclude a contract. The contract comes into effect upon our order confirmation by e-mail or, at the latest, upon dispatch of the goods.
For individually configured products (custom-printed flags, banners etc.), production starts only after upload of your print data and your release. The contract is only fully concluded with this release.
§ 3 Prices and payment
All prices are in Swiss francs (CHF), net (without VAT). Swiss import VAT (8.1% standard, 2.6% reduced) is collected by the parcel service upon delivery. Shipping and customs clearance are included; from 300 CHF net free.
Payment is due upon order. Payment methods: credit card via Stripe, PayPal, invoice payment for Swiss business customers with CHE-VAT number (from 200 CHF net, 14 days payment deadline).
§ 4 Delivery
Delivery exclusively to Switzerland and Liechtenstein. Delivery time as stated per product in the configurator (typically 5–10 business days). For express printing: 3–5 business days.
Delivery is via GLS or DHL. Tracking link will be sent by e-mail after dispatch. Custom production is shipped DDP (Delivered Duty Paid). The Swiss import VAT is collected by the parcel service.
§ 5 Right of withdrawal
For non-individualised products, the statutory right of withdrawal of 14 days applies. Details see withdrawal policy.
Custom-printed products (individual production) are excluded from the right of withdrawal per § 18 (1) Z 3 FAGG.
§ 6 Warranty
Statutory warranty rights apply. Warranty period 2 years for B2C, 1 year for B2B (subject to individual agreement). Warranty claims should be reported within 14 days after detection by e-mail to kontakt@allesfahnen.at with order number and photos.
§ 7 Liability
We are liable for damages without limitation only for intent and gross negligence. Liability for slight negligence is limited to typical, foreseeable damages. No liability for damages caused by improper use, force majeure or third-party intervention.
§ 8 Reservation of title
The delivered goods remain our property until full payment.
§ 9 Copyright on prints
You declare that you have all necessary rights for the uploaded designs (copyright, trademark rights, personal rights). You indemnify us against third-party claims arising from rights violations of your designs. We assume no responsibility for the content of customer-supplied print files.
§ 10 Storage of print data
Print data uploaded by you is stored for the period necessary for production and 12 months afterwards (for reorders), then deleted. Storage occurs in encrypted form in a secure environment.
§ 11 Data protection
The processing of personal data is governed by our privacy policy.
§ 12 Applicable law and jurisdiction
The contractual relationship is subject to Austrian law, excluding the conflict of laws and the UN Convention on Contracts for the International Sale of Goods (CISG). The application of mandatory consumer protection regulations of the country of habitual residence of the consumer (Switzerland or Liechtenstein) remains unaffected.
Place of jurisdiction for merchants and legal entities under public law is Vienna. For consumers, the statutory regulations apply.
§ 13 Final provisions
Should individual provisions of these T&C be ineffective in whole or in part, the validity of the remaining provisions remains unaffected. The ineffective provision shall be replaced by an effective provision that comes closest to the economic intent.
Changes and additions to these T&C require text form. The exclusion of text form also requires text form.
